Georgia DUI law can be complicated. Here are some things you should know:
- If you refuse the State's chemical test of your breath, blood, or urine, you are in violation of Georgia's Implied Consent law. That means that your Georgia driver's license will automatically be suspended, regardless of the outcome of your DUI case.
- There are TWO hearings involved in a Georgia DUI case—the criminal court hearing and the ALS hearing.
- The criminal court hearing will determine your guilt or innocence of DUI. The ALS hearing will determine if your Georgia driver's license will be suspended.
- Most attorneys believe that ALS hearings cannot be won and will not even bother requesting one or showing up in court. What they do not understand is that some ALS hearings can be successful, and unless they try, they will never know.
