30-Day Warning

If arrested for DUI in Varnell, Georgia, or elsewhere in Whitfield County, you only have thirty (30) days from the date of your arrest to file a request for an Administrative License Suspension (ALS) hearing. Some people have the option to install an ignition interlock device on their vehicle instead of requesting the ALS hearing. However, if the hearing is not requested or the device is not installed within the 30 days, then your Georgia's driver license will automatically be suspended.

If you have been accused of refusing the State's chemical testing of your blood, breath, or urine, then your license will be suspended for one full year. This suspension will not be eligible for a restricted permit or early reinstatement. Contact a seasoned Varnell DUI Lawyer immediately after your DUI arrest to ensure your case is on the right track from the start.

First Time DUI

If you have been arrested for DUI in Varnell and have no prior record, you face serious penalties which can cause significant disruptions in your life. Georgia law enforcement officials are cracking down to make sure anyone caught receives sufficient punishment to prevent subsequent DUIs. A first time Georgia DUI offender can face a minimum of 24 hours in jail and a maximum of 12 months in jail. However, most of the time a judge will allow a first time DUI offender to complete their jail sentence on probation. While this seems ideal, probation comes with a lot of conditions and responsibilities. Probation can also be costly with the monthly supervision fees.

Common punishments for a first DUI in Georgia can include:'

  • 12 months of probation
  • Alcohol and Drug counseling
  • 40 hours of community service
  • Fines between $300-$1,000
  • 1-10 days in jail
  • License suspension
  • DUI School

Remember, these are punishments only if you are convicted. There are lots of Georgia DUI defenses our Varnell DUI lawyers can use to defend your case. No matter the particulars of your case, there are many potential defenses to your DUI charge.

Courtroom Conduct Rules

When attending court in Whitfield County, it is critical to make a good impression. Judges, juries, and prosecutors will make assumptions based on how you conduct yourself and dress. Whatever or not you believe this is right, it is important to make sure you are giving off the right impression. Some tips we give our clients before a court appearance include:

  • Be on time
  • Dress appropriately. For women, wear modest clothing. For men, a collared shirt that is tucked in with a belt is advised.
  • Always refer to the judge as “Your Honor”
  • Be polite to the judge, opposing counsel, and court staff
  • Make eye contact when someone is speaking to you
  • Be prepared and organized

Things you should not do when appearing in Court:

  • Do not chew gum
  • Do not wear sunglasses, hats, or other head coverings
  • Do not wear revealing clothing
  • Do not bring any prohibited item into the courtroom such as weapons
  • Do not use your phone at any time.
  • Do not wear shorts
  • Do not wear open-toe shoes

If you have any questions on how you should act or what you should wear for court, feel free to contact our office. The rules of court conduct differ from county to county, so it is important to review their regulations before your court date. Dressing appropriately and being prepared can never hurt your case. Following the listed rules is the first step in defending your case. For more information about court rules, please visit our page here.
