For a DUI case to be successfully established against a suspected drunk driver, The State of Georgia must determine the following:

  • That there was reasonable, articulable suspicion to pull the suspected driver's vehicle over. Acting on anonymous tips that a driver could be intoxicated is insufficient for a traffic stop.
