State v. DG
The police found the client standing next to his vehicle in the emergency lane of a highway. The client explained that the tire had blown out while his friend was driving and the friend had left to find a payphone to call AAA. The client had been drinking and was visibly intoxicated. The police did not believe he had not been the driver and he was arrested for DUI. The charge was dismissed after the friend testified at a hearing that he, in fact, had been the driver that night and had left to find a phone because both of their phones had died earlier in the night. The Case dismissed after the actual driver came forward and admitted driving.
