State v. DW
The client was charged with DUI Drugs. Client was pulled over for weaving and the officer smelled marijuana in his car, but did not find any after a search. He submitted to field sobriety tests and then a blood test, which was positive for marijuana. Client's case was dismissed after hiring an expert who wrote a report explaining that the marijuana metabolites present in his blood were not psychoactive and so the marijuana use could not have been recent and would not have impaired his driving ability. The expert witness was a key factor in the dismissal.
