State v. GR
The client was stopped for speeding and the officer investigated and then arrested the client for DUI. The client refused to perform field sobriety tests but submitted to a State requested blood test that showed a breath test reading of twice the legal limit. The charge was reduced to Reckless Driving after the court ruled the blood test would be inadmissible at trial because the test was not performed within 3 hours of the officer stopping the client's vehicle for speeding and there was insufficient evidence to proceed on a DUI less safe charge.
