The client was stopped and cited for making a U-turn without using a turn signal and then arrested after the officer suspected he was under the influence of alcohol. The charge was dismissed after a motion hearing where the judge found there was no evidence to support the officer's claim that the client was driving erratically and determined that a signal was not necessary under the circumstances because there was no other traffic on the roadway and the client made the turn safely.
