The client was charged with DUI Less Safe combination or alcohol and drugs. His B.A.C. was .036 with Xanax in his blood. We employed an expert pharmacologist from the University of Georgia to help interpret the result. As a result we were able to show the drug was within the therapeutic level and the combination with low alcohol level would not cause impairment. We were able to convince the Forsyth County Prosecutor to reduce the case to reckless driving in his Forsyth County DUI Case.
This outcome saved the client from a DUI for the rest of his life. If also shows that no one should be assumed guilty just because there is some drug found in a person's system. Too many so called DUI Lawyers have no idea what is and is not a therapeutic drug level and how to defend their clients.
