State v. SA
The client was charged with possession less than one ounce which was found after a traffic stop. The officer thought it was suspicious that the client had stopped to pick up a pedestrian on the side of the road who the officer believed to be a prostitute. The officer had no personal knowledge that the pedestrian was a prostitute and nothing else about the client's driving was suspicious. Once the officer came into contact with the client, he smelled marijuana and searched the vehicle. Charges were dismissed after a successful motion hearing challenging the officer's reason for stopping the vehicle.
