The charge was reduced to Reckless Driving after it was determined that the officer did not comply with the NHTSA procedures for administering field sobriety evaluations. Some Georgia courts will hold police officers to the these standards. Unfortunately, most do not. Most courts in Georgia will not hold the State to any standards insofar as field sobriety testing is concerned. Most Georgia courts call field sobriety "tests" observations, not tests. Observations do not have standards and are subject to any interpretation.
