As a result of a head-on collision last Saturday, 18-year old Alexandria Cymone Brooks has been charged with DUI, and 2 counts of Serious Injury by Vehicle. She remains in custody with a $30,000 bond set in her case.
The accident occurred on Barrett Parkway, in Cobb County Georgia. She is accused of veering in the lane of another driver causing the accident.
As a result, she is facing misdemeanor charges for the DUI, Reckless Driving, and Underage Possession of Alcohol charges. She is facing 2 felony charges for the Serious Injury by Vehicle offenses, both of which carry up to 15 years in prison.
As with all cases of this nature, hopefully she will hire an accident reconstructionist because the State needs to prove both impairment and that she was at fault in the accident. The issue of “causation” is the most important factor in this type of case and may be her only defense. Also, if the other driver was also negligent, that fact will mitigate the causation element of the offense.
In a less analytical analysis of the situation, it is extremely sad to see an 18 year-old girl ruin her life in this way while hurting others. I am sure she never intended this to happen, but intent is irrelevant in this type of strict liability offense. I hope the victims recovery quickly and Ms. Brooks is treated fairly.
