Ackworth Man Killed By DUI Driver

According to the AJC, an Acworth man was killed early Saturday morning in an accident on Mars Hill Road near Cobb Parkway.  He will need the hire the best Cobb County DUI Lawyer.

James Underwood, 50, had gotten out of his cargo trailer-pulling Ford F-150 truck in an area between northbound and southbound lanes to put up signs along the roadway.  Around 12:40 AM, a southbound Chevrolet Silverado truck left its lane and crashed into Underwood's truck.  Underwood was hit by one of the trucks and fell to the ground.  He was taken by ambulance to Wellstar Kennestone Hospital where he later died from his injuries.

The driver of the Chevrolet truck was Kenneth Chitwood, 48, also of Acworth.  He was not injured in the crash and has been charged wit driving under the influence of alcohol, failure to maintain lane, and first-degree homicide by vehicle.  He was taken to the Cobb County Detention Center.

First degree homicide by vehicle is a felony. A homicide by vehicle is classified as first degree if the driver:

(1) unlawfully met or overtook a school bus;

(2) unlawfully failed to stop after a collision;

(3) was driving recklessly;

(4) was driving while under the influence of alcohol or drugs;

(5) failed to stop for, or otherwise was attempting to flee from a law enforcement officer, or

(6) had previously been declared a habitual violator.

First degree vehicular homicide is punishable by 3 to 15 years of imprisonment. If the accused had previously been declared a habitual violator, the range of punishment is five to twenty years, and at least one year of the sentence must be served.
