In the early hours of New Year's Day, a vehicle crashed into an Alpharetta police car. The driver was tested and accused of DUI.
According to reports, the police car was stopped right near the Holcomb Bridge exit on GA 400 when it was hit. The police were there helping clear an earlier crash.
According to Alpharetta police reports, the driver was nearly three times the legal BAC limit.
Breath Test in Georgia DUI Case
The legal limit is different for different types of drivers for a suspected DUI driver's BAC (Blood Alcohol Content).
If a breath test tests positive for being over the limit,
- .08 for Georgia drivers 21 and over
- .04 for commercial vehicle drivers
- .02 for drivers under the age of 21
…then you will be charged in Georgia with a DUI per se.
