An 8 month-old baby died Saturday in an alcohol-related car crash. The father of the child and driver of the car, Darren Curry, 31, has been charged with vehicular homicide as well as DUI. He will need to hire a top-rated Cobb County DUI Attorney.
The accident occurred in Cobb County on Windy Hill at South Cobb Drive just before 11PM when Mr. Curry's car veered into the eastbound lanes and collided head-on with another vehicle driven by Jose Diaz of Marietta.
Curry had two other children in the vehicle, ages 3 and 7 that were also injured but are expected to make a full recovery. None of the three children were properly restrained in the vehicle.
The three year-old needed surgery at Wellstar Kennestone Hospital for abdominal injuries. Curry and the mother of the baby were also taken to the hospital as well as Diaz, the driver of the other vehicle. A dog that was in Curry's vehicle also died.
Vehicular homicide is a very serious offense. In Georgia, vehicular homicide can be both a misdemeanor and a felony. Here's how:
Misdemeanor vehicular homicide occurs when a death has occurred as a result of a violation of traffic laws. If a person loses their life as a result of a typical traffic offense such as running a red light, the driver may be charged with vehicular homicide. A conviction of misdemeanor vehicular homicide in Georgia can bring a sentence of up to one year.
Felony vehicular homicide occurs when the death of an individual is the result of DUI or reckless driving. A conviction of felony vehicular homicide in Georgia can carry a prison term of up to 15 years in prison.
If you or someone in your family has been charged with vehicular homicide, you need an experienced attorney to help navigate you through this very serious and difficult time. Richard Lawson has successfully negotiated many cases of misdemeanor and felony vehicular homicide.
