A driver is facing serious charges after a pedestrian was struck and killed on the shoulder of I-285 south of Langford Parkway, in Fulton County Georgia. The accused will need to hire a top-rated Fulton County DUI Lawyer as soon as possible.
According to the Atlanta police, a man was hit by a car that pulled into the right southbound emergency lane of the interstate around 4:45 a.m. A passenger in the vehicle received minor injuries and was taken to Grady Memorial Hospital. According the AJC, the alleged driver of the vehicle, Tabatha Williams, 24, was charged with first-degree vehicular homicide, DUI and reckless driving. Williams is being held at the Fulton County Jail without bond.
Atlanta police did not release the identity of the victim and did not know why he was on the shoulder of the interstate; the investigation is ongoing. Ms. Williams will initially be charged with first-degree vehicular homicide because of the predicate offense of reckless driving. After the toxicology tests are completed, the State can also add further first-degree vehicular homicide charges based on DUI.
Either way, she faces up to 15 years in prison. The difference in this situation is that parole is far less likely in a first degree vehicular homicide charged based on the underlying offense of DUI versus a reckless driving-based vehicular homicide.
