I am often asked whether there is a difference if your DUI Arrest was by the GSP ( Georgia State Patrol ) or a county / city officer. The big picture answer is simply that there is no difference. The GSP is mandated to take your license if you are more than .08 grams on the breath-test or if you refused to submit to testing. In a refusal, they are also mandated to only agree to withdraw the refusal ( thereby allowing you a permit to drive ) if you agree to plead guilty to the DUI.
