Were you arrested in Georgia by the Georgia State Patrol?
I am often asked whether there is a difference if your DUI Arrest was by the GSP ( Georgia State Patrol ) or a county / city officer. The big picture answer is simply that there is no difference. Georgia DUI Law is the same in every county and city. However the nature of enforcement is actually different in the event the Georgia State Patrol made the DUI Arrest.
The GSP is mandated to take your license if you are more than .08 grams on the breath-test or if you refused to submit to testing. In a refusal, they are also mandated to only agree to withdraw the refusal ( thereby allowing you a permit to drive ) if you agree to plead guilty to the DUI. The GSP in Atlanta will almost always take the drivers license. An Atlanta DUI Lawyer is trained to help when the GSP take your license
So, in short, their mandates and regulations make their enforcement of the same laws more stick. This does not mean your case cannot be defended. It simply means that it is more difficult. As a result, if you have been arrested for DUI by the GSP, hire the best Georgia DUI Lawyer. You only have 30 days to protect your ability to drive and your freedom.
