DUI Trials in Atlanta Municipal Court

You have an absolute right to a trial in your Atlanta DUI Case. The key decision is whether to have a trial in Atlanta Municipal Court or in the Fulton County State Court. At our office we investigate every case before ever making a decision to have a trial. There are always potential defenses and possibilities.

If you elect to have your trial in the Atlanta City Court, it will be a trial by the judge only.  That is called a bench trial.  Your Atlanta DUI Lawyer will present the case without the benefit of a jury.  This can be a disadvantage since the trial judge makes the decision insofar as the guilt or innocence as well as any potential punishments. The advantage of a bench trial is the judge usually limits the potential consequences as a result of taking up less time of the court.

The other trial option is a jury trial in Fulton County.  Atlanta Municipal Court does not hold jury trails  The advantage of a jury trial is the potential to influence only one juror out of six versus just the judge  basically, there is a greater chance of convincing one juror out of six.
