Georgia Road Rage Escalates into Aggravated Assault

Posted by Richard Lawson | Jun 15, 2019 | 0 Comments

A teenager was the victim of a serious road-rage incident in Gwinnett County.

According to reports, the teenager captured the entire incident on his truck's dash camera. Another driver, identified as Emmitt Grubbs, allegedly ran him off of the road. Grubbs then blocked the teenager's truck in and rammed it with his vehicle.

Grubbs then punched the teenager in the face and took the keys to his truck from him back to his car. The teenager then ran after Grubbs to get his keys back, but Grubbs put him in a headlock and dragged him from his car around a half a mile down the road.

“As he was dragging me, he said I'm going to kill you,” the victim reported. Grubbs was arrested on charges of robbery, aggravated assault, and aggressive driving.

As a Georgia DUI Lawyer, I frequently report on episodes of road rage as it is a frequent occurrence in the state of Georgia. If you've ever driven on any of Georgia's highways, you are familiar with what I am talking about. In today's post, I will outline the traffic violation faced by Grubbs.

Aggressive Driving in Georgia

Aggressive Driving in Georgia is defined by Georgia Law in O.C.G.A. §40-6-397 as:

A person commits the offense of aggressive driving when he or she operates any motor vehicle with the intent to annoy, harass, molest, intimidate, injure, or obstruct another person, including without limitation violating Code Section 40-6-42, 40-6-48, 40-6-49, 40-6-123, 40-6-184, 40-6-312, or 40-6-390 with such intent.

Any person convicted of aggressive driving shall be guilty of a misdemeanor of a high and aggravated nature.

An aggressive driving charge can lead to a points suspension of your driver's license if 15 or more points are accumulated in any consecutive 24-month period.  An aggressive driving conviction will add 6 points to your license.  The Georgia Department of Driver Services will also assess points for aggressive driving convictions that occurred in other states.
