
Lawrenceville, Ga. – A multi-vehicle crash on Interstate 85 in Gwinnett County resulted in one fatality.
The accident occurred near the Beaver Ruin Road exit yesterday. Three vehicles were involved. The driver of the first vehicle lost control of his vehicle and struck the other two vehicles before colliding with the median. He was discovered dead at the scene of the accident by responding authorities.
The accident is still under investigation by Gwinnett County Police, however, as a Georgia DUI Attorney, I will focus on the correlation between accidents and DUI in Georgia in today's post.
DUI and Accidents in Georgia
If a DUI charge involves a car accident, the accident can be used evidence to show that the accused driver was in fact less safe to drive. Bottom line, an officer's duty is to aid all distressed or injured drivers, so if the accident results in injury or distress, the officer will investigate the cause of the accident and whether driving under the influence was a factor.
This can lead to DUI standardized field sobriety tests as well as chemical testing and result in a DUI arrest. An accident ultimately leads to more charges, which increases the legal consequences.
If the accident results in injury, and DUI is a factor, then the penalties are greatly increased. Both Serious Injury by Vehicle and Vehicular Homicide in Georgia are classified as felonies. This means some serious prison time and a years of license suspension.
