State v. DS
The client was stopped for speeding and failing to maintain lane for crossing over the fog line. He is a CDL driver but was driving his person vehicle. The client failed several field sobriety evaluations and the State breath test showed a BAC of .079. After successfully negotiating with the officer and the prosecutor, the charge was reduced to Reckless Driving and the client was able to keep his commercial driver's license which allowed him to continue working as a truck driver. The reckless driving was still a serious traffic offense but did not have the consequences of a DUI for a CDL Driver.
