State v. UJ
The client was arrested for DUI after the officer found the client passed out next to a legally parked car. No field sobriety tests were performed and the officer failed to request a State breath test. The officer did not bother questioning the client about where he had been or how long he had been sitting in the parking lot. The charge was dismissed because it could not be proven when the client had actually been driving, or if he had been driving at all.
