State v. TG

The client was charged with DUI and Fleeing and Eluding.  Kimberly Berry was the attorney.  The evidence involved Smyrna Police following the client from a bar.   When blue lights were turned on, the client did not pull over, but drove to his hotel.  The Cobb County Police responded and the client refused breath testing and field sobriety testing.  The jury did  not agree with the State's argument that the client was eluding the police.  In fact, the jury agreed a reasonable person would want to drive to a safe area before stopping.  The jury did not believe the State' s argument that the client's traffic violation was the result of alcohol impairment, and after deliberating for two hours found the client "Not Guilty."
