Reports off of I-85 yesterday showed that a suspected DUI driver hit a car after driving the wrong way. The accident ended up in the death of the other driver.
According to police, the suspected DUI driver was going the wrong way on I-85 and crashed into another vehicle - the other driver was believed to have been killed instantly. The alleged DUI driver is at a local hospital in critical condition. Officers reported smelling a “strong odor of an alcoholic beverage on and about his person.”
As a Georgia DUI Lawyer, I will outline one of the traffic violations committed by the alleged DUI driver in today's post.
Wrong Side of Roadway in Georgia
According to O.C.G.A. §40-6-40, there are laws regarding which side of the road vehicles must be on while on Georgia roads.
(a) Upon all roadways of sufficient width, a vehicle shall be driven upon the right half of the roadway, except as follows:
(1) When overtaking and passing another vehicle proceeding in the same direction under the rules governing such movement;
(2) When an obstruction exists making it necessary to drive to the left of the center of the highway, provided that any person so doing shall yield the right of way to all vehicles traveling in the proper direction upon the unobstructed portion of the highway within such a distance as to constitute an immediate hazard;
(3) Upon a roadway divided into three marked lanes for traffic under the rules applicable thereon; or
(4) Upon a roadway restricted to one-way traffic.
Practice Note
When a driver is arrested for DUI in Georgia, most of the time there are other offenses that are charged alongside the DUI.
For example, generally before being charged with a DUI, you were pulled over for some other offense such as speeding, failure to maintain lane, and all other types of Georgia traffic offenses. Once stopped, the arresting officer may find that your license is suspended or may find you possession of marijuana. There are other examples as well including the traffic offenses mentioned above.
