A Walmart truck driver from Jonesboro, Georgia was arrested early Saturday morning for causing a multi-car crash in New Jersey that killed one person and seriously injured comedian Tracey Morgan.
Sleep deprivation is suspected as the cause of the deadly accident since prosecutors say the driver, 35 year-old Kevin Roper, apparently had not slept for 24 hours prior to the accident. His first court appearance is scheduled for Wednesday and he is currently out of jail after posting a $50,000 bond.
Roper has been charged with death by auto and four counts of assault by auto.
Police say that Roper did not slow for traffic ahead of him in New Jersey's Cranbury Township and tried to swerve to keep from crashing but he instead smashed into the back of Tracey Morgan's Mercedes limousine bus and killed comedian James “Jimmy Mack” McNair.
Morgan suffered injuries and remains in critical condition on Monday. A spokesman for Morgan said the actor and comedian was “more responsive” Sunday after surgery to repair a broken leg.
It has been reported that Morgan also has a broken femur, nose, and ribs and could be hospitalized for weeks. Morgan is best known for NBC's “Saturday Night Live” and “30 Rock.”
