What happens after a DUI arrest in Atlanta

Posted by Richard Lawson | Oct 27, 2012 | 0 Comments

A DUI arrest in Atlanta Georgia is handled differently than in other Georgia jurisdictions. As with any DUI in Georgia, the statutes and laws are the same as in other jurisdictions. That is the end of any similarities. The procedures in Atlanta Municipal Court and Fulton County State Court are unique.  It is important to hire a DUI Lawyer in Atlanta to protect your rights.  Only a DUI Lawyer in Atlanta GA can understand how to navigate the Atlanta DUI Process.

If you were arrested by the City of Atlanta Police or the Georgia State Patrol (GSP) your case will either begin in Atlanta Municipal Court or in Fulton County State Court.  In either situation, you need to act quickly to protect your rights.  Without the help of an Atlanta DUI Lawyer you will likely have a suspended license and other consequences that are not necessary and should not happen if your case is properly handled by top-rated Atlanta DUI Lawyers.

If your case begins in Atlanta Municipal Court, you must act quickly.  Your Atlanta DUI Arraignment will occur within days or a couple of weeks after your arrest.  After arraignment you will be placed on what DUI Lawyers in Atlanta GA call the "rocket docket."  Within 60 days of your arrest, your case will be prosecuted.  That means your investigation must happen immediately. If you don't close your case in Atlanta Municipal Court, it will be bound over to the State Court of Fulton County.

If you were arrested by the Georgia State Patrol (GSP) the arresting State Trooper can select to send your case directly to the State Court of Fulton County.  In that event, you will not have an immediate arraignment date.  You may be thinking that your case does not need immediate attention.  Even without a court date, you still need to have your DUI Lawyer in Atlanta Georgia file your 30 day letter to protect your right to drive.

Without sending your 30 day letter and having your ALS Hearing, you could be suspended for months or even a year before getting a court date in Fulton County State Court.  Our DUI Lawyers in Atlanta Georgia will send your 30 day letter, prepare your investigation, and successfully represent you at your administrative license hearing while your case is pending in Fulton County State Court.
