What is DUI Court in Georgia?

DUI Court in Georgia is a court supervised DUI treatment program offered throughout the state of Georgia. DUI Court is usually offered to repeat DUI offenders in Georgia. If a prosecutor and a judge believe that a repeat has substance abuse issues, they will recommend DUI Court. 

This is an extremely difficult and intensive program. It's described as a zero tolerance program, and it is overseen by a State or Superior Court judge. Usually, there is very little flexibility, rigid program terms, and participants sign a 4th amendment waiver. This 4th amendment waiver allows DUI Court personnel total access to their homes and vehicles. Your home or work place can be searched at any time while you're participating in the program. If drugs or alcohol are found, you are immediately in violation. This is usually followed by a trip to jail.

The program consists of monthly fees, weekly treatment, and bi-weekly court appearances. If ordered to DUI Court, you cannot miss anything, make any mistakes, or violate any rules. Any mishaps will result in sanctions such as more classes, more community service, more time in jail, etc. 

The option for DUI Court will come up in the plea bargaining process in Georgia. DUI Court is optional meaning that you agree to it and is a term of your probation. There are phases of DUI Courts. The first phase is the most intensive of all the phases. Participants are moved up over time until graduation one year later. 

DUI Courts began in Georgia in 2002. The treatment program is modeled off of drug-court programs. DUI Court does not reduce, dismiss, or erase a DUI conviction. Most of the time entering into this treatment program results in reduced sentencing, but it isn't guaranteed.
