Will I Face Jail Time For a First DUI Conviction in Georgia?

Most of our clients are understandably concerned with whether they will have to serve time in jail for a DUI conviction and how much time they will serve. The short answer is that time in jail is possible for any DUI conviction in Georgia; however, it is not a certainty. In fact, there are arguments that can be used to eliminate the jail-time, depending on the facts of the case and the jurisdiction in which the case is being heard. 

Georgia DUI penalties have gotten more severe over the years, and now, even a first DUI comes with serious penalties.  For a first DUI in Georgia, you could face up to $1,000 in fines, 40 hours of community service, DUI Alcohol or Drug Program, and up to one year in jail. Although you could get up to one year in jail, that does not mean you will have to spend it behind bars for the whole year. The judge will let you serve most of the time on probation. 

To succeed on probation, you will have to complete the terms of your sentence, as referenced above. If you fail to complete those terms or violate the law in any other way, you can have your probation revoked. In the event of a Georgia probation violation, you can be sent back to jail for the remainder of your sentence. 

Jail Time Is Not the Only Consequence For Which You Should Be Concerned:

While jail time is a significant concern, you need to act fast to preserve your driving rights. For a first Georgia DUI arrest, you have the choice to request an Administrative License Hearing (ALS) or to install an ignition interlock device on your vehicle. If you do not file a 30-day letter or install the ignition interlock device within 30 days of your arrest, you will lose your privilege to drive!
